    What you should know about the role

    This position is responsible for an efficient and conflict free calendar for in-house legal department with a high volume of debt collection lawsuits, foreclosures and creditor-side bankruptcy matters. This position will support the in-house legal department by phone, documentation preparation, filing and service of legal documents both traditionally and electronically.

    Major Duties

    • Responsible for drafting miscellaneous legal documents under the direction of the Staff Attorney. Communicates with consumer side bankruptcy attorneys and/or their staff regarding collateral reaffirmations or surrenders. Communicates with sheriff departments’ civil divisions regarding pending foreclosures and post-foreclosure evictions.
    • Drafts and files all standard court forms required to obtain default judgments against non-appearing defendants. Drafts and files all standard court forms required to enforce judgments, including, but not limited to, periodic and non-periodic garnishments, tax refund garnishments, requests and writs to seize property, etc.
    • Reviews member accounts via multiple software platforms and communications with Collections and Risk Management staff to ensure that robust information is provided to legal process server vendor(s). Maintains relationship with vendor(s) including paying invoices. Monitors performance of vendor(s) and reports to Staff Attorney. Drafts and files standard court forms required to obtain alternate service, if necessary.
    • Ensures assets and monies recovered through legal process are applied to the appropriate account(s) in order of priority.
    • Ensures files are maintained in good order. Documents all work performed on each case in a clear, organized manner.
    • Must comply with applicable laws and regulations, including but not limited to, the Bank Secrecy Act, the Patriot Act, and the Office of Foreign Assets Control.

     

    Physical Requirements

    Perform primarily sedentary work with limited physical exertion and occasional lifting of up to 25 lbs. Must be capable of climbing/descending stairs in emergency situation. Must be able to operate routine office equipment including telephone, copier, facsimile, and calculator. Must be able to routinely perform work on computer for an average of 6-8 hours per day, when necessary. Must be able to work extended hours whenever required or requested by management. Must be capable of regular, reliable and timely attendance.

     

    Working Conditions

    Must be able to routinely perform work indoors in climate-controlled shared work environment with moderate noise.

     

    Mental and/or Emotional Requirements

    Must be able to perform job functions independently and with limited supervision. Must work effectively as part of a team. Must be able to read and carry out various written instructions and follow oral instructions. Must be able to speak clearly and deliver information in a logical and understandable sequence. Must be able to perform basic mathematical calculations with accuracy. Must be capable of dealing calmly and professionally with numerous different personalities from diverse cultures at various levels within and outside of the organization and demonstrate highest levels of customer service and discretion when dealing with the public. Must be able to perform responsibilities with composure under stress of deadline, requirements for extreme accuracy and quality and/or fast pace. Must be capable of exercising highest level of discretion on confidential matters.

    Skills & Experience

    Experience

    A minimum of one year up to three years of similar or related experience, including preparatory experience.

     

    Education/Certifications/Licenses

    A high school degree or equivalent

     

    Interpersonal Skills

    Normal courtesy in dealing with others is required. Work involves minimal contacts, usually within the organization. Contact usually involving routine, non-sensitive issues within the department.
